Terms of Service for Modario

Welcome to Modario. These Terms of Service (“Terms”) govern your access to and use of the Modario mobile application, website, and related services (“Service”), operated by Modario LLC (“Modario,” “we,” “us,” or “our”).

By accessing or using Modario, you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you must have permission from a parent or legal guardian.

2. Description of Service

Modario provides tools to upload and manage wardrobe items, generate outfit recommendations, plan outfits and schedules, receive personalized fashion insights, and access optional premium features via subscription.

3. User Accounts

You are responsible for maintaining the confidentiality of your account and all activity under your account.

You agree not to use another user’s account or attempt unauthorized access to systems or data.

4. User Content

You may upload images, wardrobe data, and other content (“User Content”). You retain ownership of your content.

By uploading content, you grant Modario a non-exclusive, worldwide, royalty-free license to store, process, and analyze your content and provide recommendations and features within the Service.

5. Image Processing and AI Use

Modario uses artificial intelligence systems to analyze uploaded wardrobe images and generate recommendations and enhancements. This may include third-party AI providers.

By using the Service, you acknowledge your content may be processed by third-party AI systems, and these systems may temporarily store or process your data to provide functionality.

6. Content Retention

User-uploaded images are stored for up to six (6) months and then permanently deleted from Modario systems. Some third-party AI providers may retain data according to their own policies.

7. Subscriptions and Billing

Modario offers optional paid subscriptions. By subscribing, you agree to recurring billing via Apple or other providers. All payments are handled by third-party platforms.

Cancellation must be handled through the platform used to subscribe.

8. Acceptable Use

You agree not to upload illegal, harmful, or abusive content, attempt to reverse engineer the Service, or use the Service for unlawful purposes.

9. Intellectual Property

All Modario content (excluding User Content), including design, branding, and software, is owned by Modario LLC and protected by law.

10. Disclaimer of Warranties

The Service is provided “as is” without warranties of any kind. We do not guarantee accuracy of recommendations, continuous availability, or error-free operation.

11. Limitation of Liability

To the fullest extent permitted by law, Modario is not liable for indirect or incidental damages, loss of data or content, or decisions made based on recommendations.

12. Termination

We may suspend or terminate your account if you violate these Terms.

13. Changes to Terms

We may update these Terms at any time. Continued use of the Service constitutes acceptance of updated Terms.
